Regular Planning and Zoning Meeting

In attendance for planning Johann Massmann, Bill Langenbacher, Mary Hill Amy Forsythe, Dan Ness.

Supervisor Board John Jones, Doug Schneider, Heath Gillham, Russell Nelson, Steve Langanki, Clerk Sandy Forsman.

 

Johann called the meeting to order.

 

Review and approval of the April 13th minutes, Mary made a motion to accept the minutes as written and Dan seconded all in favor motion carried.

 

Mr. Larry Carter appeared before the boards to ask there opinion on a plan to put two additional PIDS on a property that has been in the family for 150 years and now has three homes on that property. The family would like to have each home site as a separate PID . One  of the pieces would have 7 or 8 acres and another one acre leaving 115 acres . After discussion board looked at his survey and suggested that the piece with a proposed one acre be up graded to a 2 ½ parcel. Johann asked Larry if the county approved the separation of the one parcel of one acre, he stated Tom Salkowski thought it would be ok. Johann to check on the ruling of this separation. Mr. Carter to return with a survey and his request.

 

Mr. Robert Gruys (Midwest Auto) The boards requested Mr. Gruys to appear before them because of new information concerning Mr. Gruys business. The boards acknowledged that at no time a citizen has called the township or appeared before the boards with complaints against Mr. Gruys business. But at a hearing held at the county a petition was presented that requested that Mr. Gruys not increase his car limit and citizens appeared to complain about the business.

Two citizens asked to speak there concerns about this business Marvin Langanki, Matt Stucco. Concerns that Mr. Gruys has not from day one been in compliance with his CUP, also concerns on the containment of car fluids on the ground. Parking of vehicles on road blocking at times.

Mr Gruys stated he was not aware of the neighbors concerns, he felt there was sufficient room to park 30 cars out back in a fenced area. He states he is careful of fluids on the ground.

Mary stated that she felt that till his CUP expires in December of 2010 that the car limit should be left as stated in the original permit to see if Mr. Gruys can comply.

Bill stated that 23 names on the petition clearly indicates that neighbors are not happy with Mr. Gruys business and on his visits to the site of business he has not at any time seen just 12 cars. Bill asked how many employees are employed at the business, Mr. Gruys stated 3 Full time and 3 Par-Time.

Mr. Scott Johnson a neighbor that has Mr. Gruys cars sometimes on his property stated he has no problems with the business.

Dan Ness asked if Mr. Johnson was a employee he stated yes.

Johann asked about the cut gas line, Mr. Gruys stated that was done by a firm that he hired not him. he also stated that the county was out and looked at the sewer site and found no problem. The fence will be placed 33 feet from the center line.

Dan asked if cars will be on the side of the building. Only in the fenced in area.

 Amy stated to stay with 12 and go for a year and then review CUP again..

Dan agreed that keep it at twelve and have the yard fenced.

Bill stated he is troubled with the objections of the residents and additional letters to the county planning and zoning.

Mary made a motion to amend the original recommendation of the Planning and Zoning board on the application of Mr. Gruys to increase his car limit from 12 to 30 and to recommend that Mr. Gruys CUP stay as the original to a limit of 12 not counting employees cars and that a fence be put up to house these cars this to be reviewed again when the CUP expires 12-12-2010 Bill seconded all in favor except Amy and Dan, Johann cast his vote as yes with a vote of 3 to 2 motion carried.

 

A copy was presented to the board members of the new Planning and Zoning procedure manual, Bill suggested a form be made for future residents that appear before the board to fill out concerning there request. Bill will put together. Also notices to surrounding residents when a request comes in that may concern them and who may like to give opinions on the request. Clerk when to a class that will enable her to notify effective residents.

 

Mary asked what information has come in about the mushroom farm on 150th st.

 

Questions on the burnt home in Silver Creek , Amy and Johann to explore.

 

The new procedure manual will be put on the township web site for residents.

 

Motion to adjourn by Bill and seconded by Mary all in favor motion carried.
