REGULAR MEETING OF THE PLANNING AND ZONING BOARD

OCTOBER 9TH, 2007

7 P.M.

Steve Duncan called the meeting to order, in attendance for the planning and zoning board, Steve Duncan, Ralph Uecker, Steve Langanki, Bill Langenbacher, Johann Massmann, supervisor board, John Jones, Jim Kloster, Heath Gillham, Russell Nelson, Clerk Sandy Forsman.

 

Property of Kathleen Mathews 9011 Baker Ave.- Representation for Kathy from Eagle Realty Dave Rutledge, for the buyer Warren Nelson from Edina Realty. Question to board involves the septic system drain field on this property is located five feet into the township right-of-way and the buyer is concerned if in the future this will cause a problem for resale and is asking from the board a statement of assurance it will not. The buyer is also putting in a extra tank that would make this septic system a multi flow system.

Johann spoke and asked the question is this a road or a driveway as stated on the entrance of this property? Also Johann stated that the board can not predict what five or ten years may produce on any construction on this road. Jim stated his thoughts that the township lawyer should be consulted on the situation and if a statement of assurance could be given? John stated that he has not talked to Brian on this and would try to get some information on this situation, and consult the township lawyer. Johann made a motion to have this moved to the regular township meeting for resolution October 16th, 2007 and the supervisor board, this was seconded by Steve L. all in favor motion carried.

 

Ron Gilder appeared before the board with a proposal for his property on 15130 Elder Ave. Mr. Gilder is proposing to renovate the present brick building and remove the living area on the outside to have a supper club reside on this site. He only had a ruff draft with him and explained to the board that the building has been inspected for soundness and he would have a elevator going to the second floor and two outside exits. New well and septic would be put in. On the inside a bar with a majority of the inside space for dinning.

This would serve about 100 people. Board asked Mr. Gilder to return for the November Planning and Zoning meeting with a survey and blue print of the proposal.

 

Both boards reviewed the new proposed sign ordinance provided by the county and were please with the changes that are in the document for our township 94 corridor.

 

A resident called the township office on a neighbor that had put a dirt bike track in their back yard and stated the noise was bothersome and was there any thing the township could do? The county has no ordinances for this and neither does the township, John visited the site and talked to the property owners and found that it was just used for his two small children. The dirt was given to this property owner by the township from the Eagle Lake project, John questioned the location of the dirt and will talk to Brian on this.

In attendance were Mr. & Mrs. Mack who had appeared in August for a kennel license and had appeared before the county for application. The township board had on what was presented approved the application but when John attended the county planning and zoning found that the neighbors had concerns on this application. Mrs. Mack spoke and stated to the township board that she had no idea there had been a problem with the neighbors and assured the board there had been no intent to mislead the board on there situation and stated that she and her husband will do what ever it takes to resolve any problems with the neighbors.

 

A discussion by both boards on the future direction of the townships planning and zoning, In this discussion a article in the Wright County Journal Press was read by Jim dated October 5th, 2007. In this article it stated that the county plans to hire legal counsel to address concerns about townships that have decided to conduct planning and zoning on there own. In this article Mr. Salkowski stated in his opinion some townships are not fully prepared to legally or administratively take on this task.

Topics for the annual meeting  may be addressed to the residents on what direction they feel that they would like to see the township go. Johann stated he attended the meeting at the Clearwater Legion on the proposed power line advancement which would cross Silver Creek Township. Time frame to be about 2012.
